Preamble

The entire site www.arts-set.com is the property of the company ARTS-SET as well as all the related rights.

Any reproduction, in whole or in part, is systematically subject to the authorization of the owners.

However, links of the hypertext type to the site are authorized without specific requests.

 

1. Acceptance of Terms

The customer acknowledges having read, at the time of placing the order,

the special conditions of sale set out in these general conditions of sale and

expressly declares to accept them without reservation.

These general conditions of sale govern the contractual relationship between Arts-Set

and his client, both parties accepting them without reservation.

These general conditions of sale will prevail over all other conditions appearing in any other document,

except prior, express and written derogation.


2. Products

The photographs illustrating the products do not enter into the contractual field.

If errors are introduced, under no circumstances can Arts-Set be held liable.

Most of the products offered to its customers by Arts-Set are available on its premises.

 

3. Order

The Products and services that we offer on the Site are reserved for adults (or minors holding authorization from their legal representative allowing them to place an order on the Site) and  with the full legal capacity to place orders on the Site. We reserve the right at any time to ask You for proof of identity attesting to your age and/or the authorization of the aforementioned legal representative. We reserve the right not to respond to an order and/or to exclude from our customer/prospect database, a Buyer who has not responded to the above request or who has not complied with the principles enacted in this clause.

It is specified that the Products are intended for the personal use of the Buyer, which must not be related to the latter's professional activity, including any resale of the product.

 

The lists of ingredients used in the composition of our brand products are regularly updated. Before using a product of our brand, you are invited to read the list of ingredients appearing on its packaging as well as the technical data sheets available on the site in order to ensure that the ingredients are suitable for your personal use.

 

Any order implies acceptance without restriction or reservation of these general conditions of sale.

Automatic recording systems are considered proof of the nature,

the content and date of the order.

Arts-Set confirms the acceptance of his order to the customer at the email address that he will have communicated.

The sale will not be concluded until payment of the order.

Arts-Set reserves the right to cancel any order from a customer with whom there is a dispute relating to a previous order.

The information given by the buyer, when taking the order, commits him:

in the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility in which it could be to deliver the product.

 

4. Price

The prices of our products are indicated in Euro including VAT and excluding shipping costs.

VAT only applies to European Union countries.

The products remain the property of Arts-Set until full payment of the price.

Arts-Set reserves the right to modify its prices at any time.

But the prices of the products will be invoiced on the basis of the prices in force at the time of the registration of the orders,

subject to availability.

 

5. Availability

Our product and price offers are valid within the limits of available stocks.

However, in case of temporary unavailability of a product after placing an order, Arts-Set undertakes to notify the customer.

The customer then has the choice to accept an additional time to be delivered

(average time of 7 days subject to availability of our suppliers)

or to cancel his order and receive a refund of his order by bank transfer or Paypal credit.

 

6. Payment

The price charged to the customer is the price indicated on the site www.arts-set.com

The price of the products is payable in cash on the day of the actual order.

Payment is made by the means specified on the site in the order area.

The order validated by the customer will only be considered effective when the bank payment centers

concerned have given their consent.

In case of refusal of the said centers, the order will be automatically canceled and the customer notified by e-mail.

Furthermore, Arts-Set reserves the right to refuse any order from a customer with whom there is a dispute.

 

7. Delivery and shipping costs

The order is delivered to the delivery address indicated by the customer when placing the order.

Average order processing times (package preparation and delivery to the Post Office for shipment)

are on average 3 days (working days).

Delivery times by post are on average 48 hours (working days).

These deadlines are given for information only and have no contractual nature.

For an order of less than 80 euros including tax, the cost of preparation and delivery is 8.00 euros including tax.

For an order over 80 euros including VAT, shipping costs are free for mainland France.

For shipments to overseas territories and other destinations, the shipping costs are calculated after receipt of the order and are subject to additional payment.

Arts-Set can in no way be held responsible for the fact that a customer leaves his package delivered overdue.

If a package is returned for this reason, the reshipping costs are re-invoiced to the customer.

The Buyer can in no way claim to be reimbursed for shipping costs for reasons of delay

within the delivery times which are given as an indication.

Similarly, any delays in delivery cannot entitle the Buyer to cancel the sale,

to refuse all or part of the goods or to claim damages.

In case of products damaged during transport, it is imperative to declare it to La Poste:

the claim must be filed with the postal services in order to obtain the replacement of the damaged products.

It will be necessary to send photos of the damaged or incriminated package or products in support of your claim.

 

It is expressly agreed that the transfer of ownership of the goods ordered becomes effective as soon as they leave our warehouse.

The buyer accepts all the risks, in particular those relating to the transport and the good reception of the package.

The transport of parcels is carried out by the services of La Poste.

 

In case of missing product in a package due to out of stock or any other cause beyond our control,

the missing product(s) are either: delivered in a next order, or refunded.

 

8. Disputes

Arts-Set cannot be held liable for damages of any kind, whether material, immaterial or bodily,

which could result from the misuse of the products marketed.

Arts-Set's liability will be limited to the amount of the order and cannot be blamed for simple errors.

or omissions which may have remained despite all the precautions taken in the presentation of the products.

In case of difficulties in the application of this contract, the buyer has the possibility, before any legal action,

to seek an amicable solution, in particular with the help of:

• a professional association,

• a consumer association,

• or any other counsel of his choice.

It is recalled that the search for an amicable solution does not interrupt the “short period” of the legal guarantee, nor the duration of the contractual guarantee.

It is recalled that as a general rule and subject to the discretion of the courts, compliance with the provisions of this contract relating

to the contractual guarantee assumes that the buyer honors his financial commitments to the seller.

Complaints or disputes will always be received with attentive benevolence,

good faith is always presumed in those who take the trouble to explain their situations.

In the event of a dispute, the customer will first contact the company to obtain an amicable solution.

9. Warranty

In all cases Arts-Set cannot be held responsible for non-compliance with the regulatory provisions

and laws in force in the country of reception, the responsibility of Arts-Set is systematically limited to the value of the product

questioned, value on date of sale.

In any case, the customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 and following of the Civil Code).

On condition that the buyer proves the hidden defect, the seller must legally repair all the consequences.

(art. 1641 and following of the civil code);

if the buyer goes to court, he must do so within a “short time” from the discovery of the hidden defect

(art.1648 of the civil code)

 

10. Return and refund of products

The products can be returned by the Buyer under the conditions and according to the instructions below:

The products must imperatively be returned to Arts-Set in a perfect state of resale, in their original state,

unopened, with the cellophane intact and sealed (packaging, accessories, instructions...).

Arts-Set accepts the return of any item purchased on the site if it is returned within 14 days

from the date of receipt of his order by the Buyer.

The refund only applies for the amount paid for the products concerned:

in addition, the costs of preparing the order and the actual shipping costs invoiced by Arts-Set

will be deducted from the amount of the products refunded to the Buyer.

The shipping costs of the return package also remain the responsibility of the Buyer.

Any claim relating to an error in the products delivered or a problem with the condition of the products upon receipt

must be made by e-mail within a maximum of 48 hours working days after receipt of the package.

Beyond this period, no complaint can be taken into account.

In addition, in the event of damaged products, it is necessary to attach digital photos attesting to the damage observed.

If a package is damaged, a claim must be filed with the postal office on which the customer depends

and a copy of this complaint must be sent to us.

To return an item, the Buyer must follow the following instructions:

1. Use the original packaging to return undamaged and unopened products.

2. Attach a copy of the payment. Returns without a copy of Payment are not accepted.

11. Commercial relations

Commercial relations, whether questions relating to orders, payment, shipment tracking,

to commercial or general information is done exclusively by e-mail.

Telephone requests are neither taken into account nor processed.

12. Arts-Set cannot be held responsible for non-performance of the contract in the event of a shortage of stock or

unavailability of the product due to force majeure, disruption or

total or partial strike in particular of the postal services and means of transport and/or communications.

Arts-Set cannot be held liable for any consequential damages that may arise from the purchase of the products.

Arts-Set declines all responsibility:

- for any interruption of the site

- for any occurrence of bugs

- for any inaccuracies or omissions relating to information available on this site;

- for any damage resulting from fraudulent intrusion by a third party leading to a modification

information made available on the site

- and more generally for any direct or indirect damage, whatever the cause, origin, nature or

consequences including in particular the costs that may arise from the acquisition of goods offered on the site,

loss of profits, loss of goodwill, loss of data or any other loss of intangible property which may arise from the access of

anyone to the site or the impossibility of accessing it or the credit given to any information from

directly or indirectly from the latter.

Customers are required to read the precautions for use of the products sold on this site and

to inform any third party to whom they intend these same products.

 

13 . legal information

The provision of personal information collected for the purposes of distance selling is mandatory,

this information being essential for the treatment and the routing of the orders, the establishment of the invoices.

The lack of information leads to the non-validation of the order.

In accordance with the “Informatique et Libertés” law, the processing of personal information relating to customers

has been declared to the National Commission for Computing and Liberties (CNIL) and bears the number 1256485.

The customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification and

deletion of data concerning him, which he can exercise with Arts-Set.

Arts-Set undertakes not to disclose, free of charge or in exchange, the contact details of its customers to a third party.

In accordance with Articles L 211-4 et seq. of the Consumer Code, the Seller is required to deliver goods that comply with the order made by the Buyer and must respond to any lack of conformity existing at the time of delivery of the latter.

As such, to comply with the contract, the property must:

1° Be fit for the use usually expected of a similar good and, where applicable: - correspond to the description given by the Seller and possess the qualities that the latter has presented to the Buyer in the form of a sample or model; - present the qualities that a Buyer can legitimately expect given the public statements made by the Seller, by the producer or by his representative, in particular in advertising or labeling;

2° Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the Buyer, brought to the attention of the Seller and which the latter has accepted.

Similarly, in accordance with article 1641 of the Civil Code, the Seller is bound by the guarantee for hidden defects in the thing sold which render it unfit for the use for which it is intended, or which reduce this use so much that the The buyer would not have acquired it, or would have given only a lesser price for it, if he had known them.

If the Products delivered do not conform to the Products ordered by the Buyer or if they have hidden defects, the latter must send an e-mail to the Seller's Customer Service to notify it of the non-conformity or the hidden defects of its Product(s). In accordance with article L 211-12 of the Consumer Code and 1648 paragraph 1 of the Civil Code, the Buyer has a period of 2 years following his purchases from the delivery of the Products purchased to exercise the guarantee. against latent defects or the legal guarantee of conformity. Any claim made after this period of 2 (two) years from the date of taking possession of the goods in the event of non-compliance or from the discovery of the defect in the event of hidden defects will be rejected and the Seller will be released from any responsibility.

The Seller's Customer Service acknowledges receipt of the Buyer's request and confirms the procedure to be followed. Upon receipt of the instructions from the Seller's customer service, the Buyer returns the non-compliant Products or Products affected by a hidden defect to the Seller at the following address:

The Product(s) must imperatively be returned complete, unused, in its (their) original packaging intact and  accompanied ) of its (their) original packaging as well as the return form communicated by

the Seller's customer service and the invoice.

Furthermore, the Seller does not accept parcels sent postage due.

Any risk related to the return of the Product(s) is the responsibility of the Buyer.

Upon receipt of the Product(s) presumed to be non-compliant or affected by a latent defect, the Seller carries out an inspection of the Product(s) to ascertain whether or not the said Products are compliant. Similarly, the Seller may carry out a quality test on the Product(s) returned by the Buyer to verify that the Product(s) returned are indeed Product(s). (s) of origin. It is understood that these checks are carried out as soon as possible and within a maximum period of one (1) month.

If the non-compliant nature of the Product(s) is confirmed or the hidden defect is proven, the Seller will then proceed, at the Buyer's choice: - either to reimburse the non-compliant Product(s) or affected by a hidden defect as well as shipping costs, depending on the method of payment used by the Buyer, within fourteen (14) days after receipt of the Product(s) not compliant, - either the exchange of the non-compliant Product(s) or affected by a hidden defect at the request of the Buyer. The sending of the Product(s) to the Buyer is done at the Seller's expense and according to the conditions of these GCS.
